The Ministry of Commerce has publicly named an Afghan resident in Buraidah who was convicted of commercial concealment in restaurants. Learn about the details of the court ruling and the penalties, which included imprisonment, a fine, and deportation.

The Saudi Ministry of Commerce announced that it has publicly named and shamed an Afghan resident following a final court ruling convicting him of commercial concealment in the restaurant sector in Buraidah, Qassim region. This announcement comes as part of the ministry's intensified inspection and monitoring campaigns to apprehend violators of the anti-commercial concealment law.

Details of the crime and the evidence seized

Investigations conducted by oversight teams revealed the expatriate's involvement in managing a restaurant establishment. The Ministry seized conclusive physical evidence confirming his exercise of the powers of the actual owner. This evidence included his procurement of goods, payment of rent, payment of employee salaries, collection and possession of business revenues, and transfer of these funds outside the Kingdom. This constitutes a clear violation of applicable regulations that prohibit non-Saudis from working for themselves or enabling Saudis to allow non-Saudis to conduct business activities in their name.

Penalties issued against the convicted person

The Ministry of Commerce published the text of the court ruling issued by the Criminal Court in Riyadh, which included deterrent penalties against those who concealed the illegal activity, including:

  • Four months imprisonment.
  • A fine of ten thousand riyals was imposed.
  • The resident will be permanently deported from the Kingdom of Saudi Arabia after serving his sentence.
  • He was prevented from returning to work in the Kingdom in the future.
  • The ruling was published in a local newspaper at the expense of the offender.

The importance of combating commercial concealment and its economic impact

The Kingdom of Saudi Arabia places great importance on combating commercial concealment due to its severe negative impact on the national economy. This crime is a major contributor to the growth of the "shadow economy," leading to unfair competition for citizens and entrepreneurs and resulting in a decline in the quality of services and products offered. Furthermore, commercial concealment facilitates the illicit outflow of funds abroad, weakening the local economic cycle and negatively affecting the gross domestic product.

National Program to Combat Concealment

This ruling aligns with the efforts of the National Program to Combat Commercial Concealment, a collaborative initiative involving several government entities aimed at eradicating all forms of commercial concealment. The program seeks to create a regulated and fair competitive business environment, empower citizens to conduct business securely, and promote e-commerce and the use of electronic payment channels to reduce cash transactions that facilitate commercial concealment.

Strict legal penalties

It is worth noting that the new anti-concealment law stipulates severe penalties to deter violators, including imprisonment for up to five years and fines of up to five million riyals, in addition to the confiscation of illicit funds after final court rulings. Additional penalties include the cancellation of the commercial registration, the revocation of licenses, the dissolution of the establishment, and a five-year ban on the concealer from engaging in commercial activity, thus underscoring the state's determination to eradicate this phenomenon completely.
